Desktop app licence

This licence covers the alphaTrack desktop applications — jex, jit, jtm and jxt — supplied by AlphaTrack LLC, an Indiana limited liability company ("we", "us"). It is the licence for the program you downloaded and run on your own computer. The alphaTrack website and its web trackers are covered separately by the Terms of Service at https://alphatrack.net/tos.html.

By installing or using the software you accept this licence.

1. What you get

A perpetual, non-exclusive licence to use the software. One purchase, no renewal, no expiry.

• Install and use it on as many computers as you own or personally control.
• Use it for personal work and for commercial work, including work you are paid for and work done for an employer or a client.
• Keep every version. A licence granted for an app covers every past and future version of that app at no further cost.
• Keep using it indefinitely. The software performs no licence check of any kind and contacts no server, so it does not stop working if your account, this website, or we ourselves cease to exist.
• Make copies for backup and for deployment onto your own machines.

jtm is licensed free of charge on the same terms.

2. What you may not do

• Redistribute, resell, sublicense, rent, lend or publish the software, or make it available for other people to download.
• Share access to your alphaTrack account so that other people can obtain it.
• Remove or alter this licence file, or any copyright or authorship notice.
• Reverse-engineer, decompile or disassemble the software, except to the extent that applicable law expressly permits despite this restriction.

Nothing here restricts what you may do with the files the software opens, edits or creates. Those are yours; the licence is about the program, not your work.

3. Your data

The software contains no networking code. It cannot send anything anywhere, because there is nothing in it that opens a network connection. It collects no telemetry, performs no update check, and reports no usage.

It reads and writes only:

• the files and folders you point it at;
• its own settings, in a plain text file under your home directory (~/.jex/settings.txt and equivalents), which you are free to read and edit.

Nothing about your use of the software reaches us. There is no privacy policy to read for the app itself because there is no data flow to describe.

4. Payment and refunds

While alphaTrack is invite-only, these applications are supplied free of charge to account holders and no payment is taken. Prices shown on the website are what they will cost once purchasing is available.

When purchasing becomes available, refund terms will be stated at the point of sale, and any statutory right of withdrawal that applies to you will apply in addition to them.

5. No warranty

The software is provided "as is", without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the software is free of defects, that it will meet your requirements, or that its operation will be uninterrupted or error-free.

You are responsible for keeping backups of anything you value. Some of these programs delete, move and overwrite files at your instruction; use them the way you would use any other tool that can do that.

6. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, nor for lost data, lost profits or business interruption, arising out of or relating to the software.

Our total liability for any claim relating to the software will not exceed the amount you paid for the licence to that application, or ten US dollars, whichever is greater.

Nothing in this licence limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, this licence does not affect your statutory rights.

7. Termination

This licence ends if you materially breach section 2 and do not remedy the breach within 30 days of being asked to. On termination you must stop using the software and delete your copies.

We cannot terminate a licence remotely — there is no mechanism in the software by which we could — and we will not terminate one because you stopped paying for something else, because you closed your alphaTrack account, or because we discontinued the product.

8. Governing law

This licence is governed by the laws of the State of Indiana, United States, without regard to its conflict-of-laws rules. If you are a consumer resident elsewhere, you keep the protection of the mandatory consumer laws of the country you live in.
